Terms of use

These Terms of Use ("Terms") constitute a legally binding agreement between you and D Caruana trading as RingTradie (ABN to be shown here once registered), trading as RingTradie ("we", "us", "our"), in respect of your access to and use of the RingTradie website, related applications, and any associated services (together, the "Service"). By accessing the Service, creating an account, submitting a listing, requesting a quote, submitting a review, paying a fee, or otherwise using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy, Refunds Policy, and (if applicable) the Prize terms. If you do not agree, you must not use the Service.

1. Definitions and interpretation

In these Terms, unless the context requires otherwise: "Account" means a registered user account; "Consumer" has the meaning given in the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth) ("ACL"); "Finder" means a person who uses the Service to search for, contact, or obtain a quote from a Tradie; "Listing" means a directory profile, including any biography, licence number, certificate image or other material uploaded by a Tradie; "Monthly Pass" means the recurring subscription described in clause 8; "Ring" means a one-time fee to unlock a telephone number associated with a Listing; "Tradie" means a tradesperson, contractor or other service provider who submits a Listing; and "you" means the person accessing the Service. Headings are for convenience only and do not affect interpretation. A reference to a statute includes that statute as amended. The word "including" is not a word of limitation.

2. Eligibility

The Service is offered only to individuals who are at least 18 years of age and who are accessing the Service from Australia. By using the Service you represent that you meet those requirements and that you have capacity to enter a contract. If you use the Service on behalf of a company or other entity, you represent that you are authorised to bind that entity, and "you" includes that entity.

3. Nature of the Service

The Service is an online directory and introduction platform. It enables Finders to browse Listings and, subject to payment of applicable fees, to obtain contact details so that they may communicate directly with Tradies. We do not provide building, plumbing, electrical, plastering or any other trade services. We are not a builder, head contractor, labour hire provider, or employment agency. We do not hold a licence under the Queensland Building and Construction Commission Act 1991 (Qld) or any equivalent licensing statute in another State or Territory in respect of work performed by a Tradie. Nothing in the Service constitutes an offer by us to carry out building work, a recommendation of any particular Tradie, or a warranty as to fitness, skill, availability or insurance.

Any contract for the performance of work, supply of materials, or provision of a quote is solely between the Finder and the Tradie. We are not a party to that contract, we do not supervise performance, and we have no obligation to mediate, complete, or pay for that work.

4. Accounts

You may be required to create an Account to access certain features. You must provide accurate information, keep your login credentials confidential, and notify us promptly if you suspect unauthorised use. You are responsible for all activity that occurs under your Account. We may refuse, suspend or terminate an Account at our discretion where we reasonably consider the Account is being used in breach of these Terms, to harass another person, to submit false information, or in a manner that may expose us to legal risk. Termination does not affect any accrued rights.

5. Listings

A Tradie may submit a Listing free of charge. The Tradie warrants that all information in the Listing (including names, contact details, trade category, years of experience, biography, licence numbers and any certificate, ticket or qualification image) is true, current and not misleading. The Tradie warrants that they hold every licence, registration, endorsement and insurance required by law to perform the trade they advertise, in the State or Territory in which they offer to work. Where a law requires a licence number to be displayed in advertising (including, without limitation, QBCC advertising requirements in Queensland and equivalent electrical, plumbing or other occupational licensing rules), the Tradie must include that number in the Listing.

By submitting a Listing the Tradie grants us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and communicate the Listing (including uploaded files) for the purpose of operating the Service. The Tradie consents to a Finder who has paid a Ring or who holds a current Monthly Pass being shown the Tradie's telephone number and contacting the Tradie about work. We may edit, refuse or remove a Listing that we reasonably consider is inaccurate, unlawful, offensive, or otherwise inconsistent with these Terms. We are under no obligation to monitor Listings and we do not undertake to verify licences, insurance, identity or work history.

6. Certificates and rankings

A Tradie may optionally upload a copy of a qualification, licence or ticket and may enter a licence or ticket number. Any badge, label or indicator displayed in connection with that material signifies only that the Tradie submitted a file or text. It is not a representation by us that the document is genuine, current, or applicable to the work a Finder may request. Rankings and star ratings are generated from user-submitted reviews and related signals. They are not an assessment, endorsement or inspection by us.

7. Reviews and quotes

A Finder may request that a Tradie provide a quote, and may submit a review of a job. Reviews must be the honest opinion of the reviewer about work actually performed. You must not submit a review that is defamatory, false, paid-for, or submitted for a competitive purpose. We may remove content at our discretion. A review is the reviewer's opinion and is not our opinion. Quote requests are a message-passing facility only; we do not warrant that a Tradie will respond or will honour any figure discussed.

8. Fees, billing and cancellation

Browsing names, trades, suburbs and other non-telephone information is free. Telephone numbers associated with Listings are not displayed until a Finder pays a Ring of $2.00 AUD for a nominated Listing, or holds a current Monthly Pass of 99¢ AUD per month. Fees are charged in Australian dollars. Unless we notify otherwise, amounts are GST-inclusive if GST applies, and are otherwise exclusive of GST until we are registered. A fee is consideration for access to contact information on the directory. It is not consideration for trade labour, materials, or the outcome of any job.

A Monthly Pass is a recurring subscription. It renews each month until cancelled. You may cancel at any time from the Account page. Cancellation takes effect at the end of the then-current paid period; we do not make cancellation materially more difficult than purchase. Refunds, if any, are dealt with in the Refunds Policy. We may change fees by updating the Service. A change does not affect a Ring already paid. A change to the Monthly Pass applies from the next renewal after notice on the Service.

9. Prize promotion

From time to time we may invite Tradies to enter a promotional draw. Entry is optional and free. The draw is a game of chance. Participation is subject to the Prize terms published on the Service. Nothing in a Listing form or in marketing copy is a representation that you will win, or that a draw will occur on a date of your choosing. Permits, if required by a State or Territory, will be identified on the Prize page when obtained.

10. Acceptable use

You must not: (a) scrape, harvest or bulk-download contact details except as expressly permitted after payment of a Ring or Monthly Pass for your own genuine hiring purpose; (b) introduce malware or attempt to circumvent technical measures; (c) impersonate another person or submit a Listing for a trade you are not authorised to represent; (d) use the Service to send unsolicited commercial electronic messages except as permitted by the Spam Act 2003 (Cth); (e) interfere with another person's use of the Service; or (f) use the Service for any unlawful purpose.

11. Intellectual property

We (or our licensors) own all intellectual property in the Service, including the RingTradie name, layout, software and compiled directory (excluding content you upload). You retain ownership of content you submit. You grant us the licence in clause 5. You must not copy, reverse engineer or commercially exploit the Service except as allowed by law.

12. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Telephone numbers of Tradies are disclosed to Finders who have paid the applicable fee, as described in the Privacy Policy and these Terms.

13. Third party contractors

You acknowledge that Tradies are independent third parties. We do not employ, engage, or control them. Without limiting any other clause, and to the maximum extent permitted by law, we are not responsible for, and you assume all risk in connection with: the performance, non-performance, quality, timing, pricing or safety of any work; any act or omission of a Tradie, worker, subcontractor or supplier; the existence, validity or scope of any licence, registration or insurance; the accuracy of a Listing, certificate image, ranking or review; any deposit, cash payment or invoice passing between a Finder and a Tradie; and any dispute between a Finder and a Tradie. You agree that you will make your own enquiries, including as to licensing and insurance, before engaging a Tradie.

14. Exclusion of certain claims

To the maximum extent permitted by applicable law, you release and forever discharge D Caruana trading as RingTradie, and its officers, employees and agents, from all claims, actions, demands and proceedings (whether in contract, tort including negligence, statute, equity or otherwise) arising out of or in connection with: (a) work carried out or not carried out by a Tradie; (b) loss of or damage to property; (c) personal injury or death; (d) theft, conversion, or failure to return a deposit; (e) unlicensed, uninsured or misrepresented services; (f) a quote, variation, invoice or payment dispute; (g) reliance on a ranking, badge, biography, review or uploaded file; (h) content posted by another user; (i) our decision not to verify a Listing; and (j) participation in a promotional draw, including that you do not win. The foregoing does not apply to a claim that cannot be excluded in respect of our supply of the Service itself under the ACL (for example, where a paid Ring does not result in disclosure of the relevant telephone number, in which case the Refunds Policy applies).

You agree that you have not relied on any representation by us as to the skill, licence, insurance, availability or character of any Tradie, except representations that cannot be excluded by law.

15. Indemnity

You indemnify D Caruana trading as RingTradie and its officers against all loss, damage, liability, cost and expense (including reasonable legal costs) arising out of: your breach of these Terms; your Listing or other content; your use of a telephone number obtained through the Service; work you perform for a person who contacted you via the Service; and any claim by a third party to the extent it arises from your acts or omissions. The indemnity is reduced to the extent a court finds the loss was caused by our breach of these Terms or by our negligence in supplying the Service.

16. Liability

If you are a Consumer, you have rights under the ACL that cannot be excluded, including as to due care and skill and that services be fit for the purpose we represent in relation to the Service itself. Those rights apply to the directory and paid access to contact information. They do not convert us into a party to a building contract, and they do not make us liable for a Tradie's workmanship.

To the maximum extent permitted by law, we exclude all warranties and representations that are not expressly set out in these Terms. Where our liability in respect of the Service cannot be excluded, it is limited, at our option, to resupply of the relevant Service or payment of the cost of resupply, or a refund of the amount you paid us for that Service. We are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, or loss of data, except to the extent that liability cannot be limited.

17. Suspension and take-down

We may, without liability, suspend access to the Service or remove content where we reasonably believe it is necessary to comply with law, to protect the Service, or to address a complaint. We may restore or permanently remove content as we see fit.

18. Variations

We may amend these Terms by publishing a revised version on the Service. The revised Terms take effect on publication. Your continued use of the Service after that date constitutes acceptance. If you do not agree, you must stop using the Service and, if you hold a Monthly Pass, cancel it from the Account page.

19. General

These Terms, together with the policies referred to in them, constitute the entire agreement between you and us in respect of the Service and supersede prior understandings. If a provision is held invalid or unenforceable, it is to be read down or severed and the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign your rights without our prior written consent. We may assign or novate these Terms on notice. Clauses which by their nature survive termination (including clauses 5, 11, 13, 14, 15 and 16) survive. Notices may be given by email to the address associated with your Account or by posting on the Service.

20. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland. Complaints about the Service may be sent to hello@ringtradie.com. You may also contact the Office of Fair Trading in your State or Territory, or the Queensland Office of Fair Trading.
